Basic Principles

40. (c) If there arises a state of emergency that could cause disintegration of the Union, disintegration of national solidarity and loss of sovereign power or
attempts therefore by wrongful forcible means such as insurgency or
violence, the Commander-in-Chief of the Defence Services has the right
to take over and exercise State sovereign power in accord with the
provisions of this Constitution.

ႏုိင္ငံေတာ္၏ အခ်ဳပ္အၿခာအာဏာကို ဆူပူေသာင္းက်န္းမူ၊ အၾကမ္းဖက္မူ စေသာ အဓၶမနည္းၿဖင္႕ ရယူရန္ ေဆာင္ရြက္ၿခင္း၊ သို႕မဟုတ္ ၾကိဳးပမ္းအားထုတ္ၿခင္းေၾကာင္႕ ၿပည္ေထာင္စု ၿပိဳကြဲေစမည္႕၊ တိုင္းရင္းသား စည္းလံုးညီညႊတ္မူ ၿပိဳကြဲေစမည္႕ သို႕မဟုတ္ အခ်ဳပ္အၿခာအာဏာ လက္လႊတ္ဆံုးရံွဳးေစမည္႕ အေရးေပၚ အေၿခအေန ေပၚေပါက္လွ်င္ တပ္မေတာ္ ကာကြယ္ေရးဦးစီးခ်ဳပ္သည္ ႏုိ္င္ငံေတာ္ အာဏာကို ဤဖြဲ႕စည္းပံု အေၿခခံ ဥပေဒတြင္ သတ္မွတ္ၿပဌာန္းခ်က္ႏွင္႕ အညီ ရယူသံုးစြဲခြင္႕ရွိသည္။

လြယ္လြယ္ေၿပာရင္ အာဏာသိမ္းလုိ႕ရတယ္ေပါ႕။

Ko Ko Gyi>>> Seems legitimate and reasonable but the decision to coup should not be in the “Commander-in-Chief of the Defense Services” but the elected President, Vice Presidents, Home Minister, Defense Minister, Foreign Minister, Police Chief, SB Chief, Military Intelligence (equivalent to that post, if any), Parliament Chairman, Election Commission, States and Division Chief Ministers…should be called for emergency meeting and request the Military to control for THREE MONTHS with three monthly extensions. New Election must be held within ONE year. …This is my proposal only. Constitutional Law experts would decide in accordance with the International practice after discussion with UN and HR authorities. “Commander-in-Chief of the Defense Services” should NOT be given a BLANK CHEQUE to act alone.
