(Their parents were my lecturers) And SMAR Nyi Nyi is my brother. So I have a right to know the truth and wish to see them punished if they are really guilty at ICC.

    The following fact is not proven but my suspect only or opinion I got after listening to the true stories of my two brothers involved in this case.
    I strongly SUSPECTED that this started from the young innocent (or politically and socially… not matured) university students’ campaign of Eradication of Opium drugs production. As we know that a small part of the Kachin leaders are involved in this opium production and trade, they may had asked the Moe Nhyin Kachin ABSDF youths to topple the Mdy ABSDF educated youths. They knowingly used the Military Intelligent, MI’s Myet Khin Thit magazine’s propaganda article of boasting that their spies were in the ABSDF. MI article just tried to put a wedge in the ABSDF to start cracking. Even if they really have spies, why need to inform the enemy about your spies amongst them?
    That story was used by the Aung Naing’s group to start the coup and it degenerated into a massacre.
    Thai female journalist Yindee was there, my brother SMAR NN translated for her. SMAR NN’s and other detainees’ photo was published in FEER (Far Eastern Economic Review) by Bertil Litner. Although many people including me published about this, there is no response from NLD and International authorities including USA, UK and UN.
    My another brother went to rescue/negotiate there, of course after informing MI and US/UK Embassies….he is going to publish a book, in Burmese. SMAR Nyi Nyi had also written his experience in English, wish to publish later.

    The “Kachin Massacre” was committed in northern Burma by members of the All Burma Students’ Democratic Front (ABSDF), an armed group fighting the military. February 12th is a date of great significance for Burma. On that historical day in 1…947, national hero Aung San and ethnic nationalities leaders signed the Panglong Agreement, which granted equality and national self-determination for all the people of Burma, and the date has been commemorated ever since. But on the 45th anniversary of what is now known as Union Day, in the jungles of Kachin State, a group of Burmese democracy activists were murdered under shadowy circumstances in 1992. The “Kachin Massacre” was committed in northern Burma by members of the All Burma Students’ Democratic Front (ABSDF), an armed group fighting the military regime from its bases along the border with China, Thailand and India. The victims? Not soldiers from the hated junta or their sympathizers; but 15 members of their own organization. Lawlessness in the jungle is not new to Burma’s struggle against military dictatorship. In the 1960s, communist party members who took up arms in the jungle to fight the central government committed several purges against their own members. But when an estimated fifteen ABSDF members were executed on charges of espionage in Pajau, Kachin State, it marked a new episode in Burma’s sometimes bitter internecine feuding. More than ten years later, many dissidents who still belong to the ABSDF are reluctant to discuss the crimes in the jungle for fear of opening old wounds as the incident has come back to haunt former ABSDF chairman, Dr Naing Aung. Poised to study at Harvard University’s Kennedy School of Government later this year, Dr Naing Aung’s scholarship was deferred indefinitely after Harvard learned of his alleged role in the executions from protest letters sent by human rights activists and professed victims of the ABSDF’s crimes. In recent years, three former prominent ABSDF members have been granted scholarships at Harvard. But questions over the judicial process and the guilt of the executed have resurfaced since the chairman was refused entry into the university. Dr Naing Aung, now the executive director of the Network for Development and Democracy (NDD), declined an interview with The Irrawaddy. A former ABSDF colleague now living in a Western country commented that Dr Naing Aung may not have ordered the killings but could be guilty of protecting the executioners. Aung Naing, who was then chairman of the northern ABSDF and is now a policy board member of the NDD, told The Irrawaddy that they executed 15 ABSDF members for working as spies for the military regime. He said about 80 members had been detained on similar espionage charges since mid-1991. The excesses of Burma’s military intelligence services are well known, but many observers question why Rangoon would send such a large number of spies to one place. A more likely theory, they say, is that the executions were a result of a power struggle within the ABSDF. Reports from those who escaped from execution and fled to the Thai border said it was possible that some of the 80 suspects may have been spies, but the majority of those detained were genuine democracy activists. Among those executed was Htun Aung Kyaw, chairman of the northern ABSDF until he was arrested for spying. During the 1988 democracy movement, he was a prominent student leader in Mandalay, Burma’s second largest city, and was a vice-chairman of the All Burma Federation of Students Unions (Upper Burma) before he left for Kachin State. Htun Aung Kyaw’s outraged relatives and other activists in Mandalay want to keep those who ordered and committed the executions out of the city. “They are not welcome here,” said one prominent Mandalay dissident. However, the unsubstantiated evidence surrounding the executions has left the current ABSDF top brass in a messy and complex public relations imbroglio. “I don’t want to give any comment on that incident at the present time,” said Than Khae, present chairman of the ABSDF. When pressed further, he added, “The event will be very controversial even when it is solved in the future.” Aung Naing and other ABSDF members who were involved in the executions insist that they had substantial evidence and confessions to support their spy charges. Other members and leaders of the ABSDF, however, maintain those claims are false and have denounced the killings. Min Htay, a military trainer with the northern ABSDF at that time and currently a representative of the same group, said he was almost certain a few of the detainees were government moles, but knows of at least one woman arrested for espionage, Nan Saw, who was not a spy. Nan Saw and a large group of other suspected spies managed to escape execution. Many have since returned to Burma and others are now believed to be residing in western countries.See More

    Most could not be reached for comment. One prisoner who was not so lucky, however, was Maung Maung Kywe. He was first actively involved… in the Basic Education Student Union (BESU), which was established in 1988, before later receiving military training with the ABSDF in Kachin State. Initially, Maung Maung Kywe joined the democracy movement to fight against the military regime, said his friend and former BESU colleague, Nay Lin, but was later executed with 14 others for being spies. But some believe that the internal purges actually claimed many more lives. Moreover, some have come out recently admitting that suspects were tortured in detention. A senior ABSDF member, who was an eyewitness to the event, said that besides the 15 who were executed about five to 10 people died due to torture during the interrogation, including U Sein. U Maung Maung Tate, who was a former political prisoner with U Sein in the 1970s, and is now the chairman of the ABSDF’s three-man central judiciary committee, said, “U Sein had very strong political beliefs in prison, so it is difficult for me to believe that he was a spy.” Aung Naing said that U Sein died in detention from poor health, not torture. He did admit, however, that beatings and electric shocks were applied during the interrogation, but could not confirm how many died in detention. Labya Laseng, a member of the central committee of the ABSDF in 1992, said that three detainees committed suicide during the interrogations. Others have said that some detainees who later escaped—including women—were tortured and now suffer severe mental illnesses as a result. ABSDF leaders in Kachin State explained that they approached international organizations such as the International Committee of the Red Cross (ICRC) and the United Nations High Commissioner for Refugees (UNHCR) to accept the detainees, but these organizations could not take any responsibility, although Amnesty International issued a request to stop the executions. Aung Naing, who has close ties with the former chairman, told The Irrawaddy that Dr Naing Aung had nothing to do with the executions: “The capital punishment was ordered by the central committee of the northern ABSDF though we informed the ABSDF central headquarters,” explained Aung Naing. “We had our own authority and the capital punishment was decided by eight members of the central committee of northern ABSDF, including Kyaw Kyaw, Than Chaung, Myo Win, Sein Aye, Aung Gyi, Nay Tun, Labya Laseng and myself.” At the time of the executions in 1992, the ABSDF was already divided into two rival groups: one headed by Moe Thee Zun and the other by Dr Naing Aung. Aung Naing Oo, who served as spokesman of the foreign affairs department of the Moe Thee Zun group said, “We officially stated that we had no connection whatsoever with that incident and also denounced the atrocities.” A few years later, more atrocities in the jungle would follow. In one instance in 1997, Myo Win, a senior ABSDF member, ordered the execution of Soe Win on charges of “leaking information”. But Myo Win failed to inform the central committee, thus stirring up more discontent within the organization. Aung Naing Oo, who studied at Harvard’s Kennedy School a few years ago, said that he had had enough and resigned from the ABSDF in 1999. In a 1999 interview with The Irrawaddy, Dr Naing Aung said that “even though we have the death penalty, we try to avoid it as much as we can since we have been blamed by international organizations about our executions with the spies.” When asked if he was comfortable with the decisions to execute former members, he said: “As the head of the organization, sometimes I’m not only worried, I’m afraid. Because in some situations [where] you have to take responsibility, you don’t really see what happened, and you have to rely on [others’] reports.” Nevertheless, many dissidents still believe that the ABSDF’s ugly past will continue to haunt their former leaders. Some warn that Dr Naing Aung’s suspended admission to Harvard could be just the beginning of wider repercussions that will reach others in the dissident community who committed acts of injustice. Whether Harvard will continue its regular scholarship program with Burmese students is uncertain. Aung Naing blamed the ABSDF’s judicial quandary on Burma’s pervasive militarism and weak education system: “Although we talked about democracy and human rights, we didn’t thoroughly realize what democracy and human rights meant. Our education system did not prepare us to understand those concepts.” For those who have fled Burma in opposition to the killing and persecution perpetrated by the military regime, some have been subjected to similar inhumanities on occasion within their own dissident groups during their 14-year struggle for democracy.

    Aung Naing had admitted to the executions of young ABSDF students in the book:

    “All Wars Are Dirty” by PHIL THORNTON

    He had given lame excuses of not knowing or understanding the Human Rights and democracy. He also wrongly claimed that the killings were not politically motivated and nobody gained any political advantage.

    The worst part was that he never mentioned the tortures and the actual number of executions was much more than he admitted.

    He claimed and blamed the KIO, Amnesty International and the ICRC with the following statement, “before we made it we approached, through the KIO, Amnesty International and the ICRC [International Committee of the Red Cross]. We needed help; we wanted to hand the prisoners over to them. They said they couldn’t do anything, as they could not reach us on the Burma-China border.”

    We need to investigate whether AI and ICRC actually got the news and refused to accept the student rebel prisoners. If they really get the message but acted irresponsibly they should be condemned because it is not very difficult to reach the ABSDF Camp through Burma, as many parents and relatives had really done that after informing the Burmese government and the Foreign Embassies like USA, British and Japan. We knew that the remaining students were released by the help of KIO/KIA without the knowledge of Aung Naing and new ABSDF leaders.

    Aung Naing, we need a War Crime Tribunal but not merely an investigation like South Africa’s Truth Commission. Sorry, we could see your cunning wits of wishing to be free or off the hook even before you were caught.

    To be fair to you, we wish to know why some of your partners in crime who were caught by Myanmar Military were not tried with the war crimes. May be they don’t wish to open their secret MI files but even if few of them were actually spies you have no right to torture hundreds and killed about fifty of them.

    Just because MI’s “Myet Khin Thit” put a propaganda wedge by claiming that their spies had successfully infiltrated the ABSDF, your group led by ‘Shanis’ staged a coup, arrested, tortured and killed the fellow student rebels. If you had a sound and reasonable mind, you should understand or see through that propaganda warfare. No government nor any enemy would just easily declare that their spies had successfully infiltrated the opposing enemy and risks the exposures of their valued informants.

    When I ran the journalism-training workshops on the border, I worked with either a Burmese or Karen translator, depending on the group. One of these translators was Aung Naing, the former Burmese student leader I had interviewed about NGOs. He was now a journalist, politically aware and with a sharp sense of humour. I particularly enjoyed working with him, and he had a very interesting history I was curious to find out more about.

    Aung Naing had the face of a choirboy, and he dressed like the doctor he should have become: neat blue shirt tucked into charcoal trousers. His English was excellent. He laughed easily as he joked around the edges of the tragedy that was his life. He was a former chairman of the All-Burma Students’ Democratic Front [ABSDF) for northern Burma, and had played a central role in one of the biggest scandals to hit at the heart of the Burmese student army.

    On February 12,1992, student soldiers executed fifteen of their comrades accused of spying for the regime. I wanted to interview Aung Naing about it, as he was one of the leaders who ordered the executions. It was a tough place to put him in, although he was surprised that no one had ever interviewed him about the incident before. He agreed, and we met in Mae Hong Son—where his group’s classes were held—at the house of a Burmese doctor, where I was staying. Aung Naing judged it would be a long night as I placed my notebook and tape recorder on the table. He responded by getting a bottle of whiskey and a cooler of ice. He drank heavily as we talked. I let the tape recorder capture his testimony.

    “In 1988 I was studying medicine in Mandalay. I was a student leader during the pro-democracy demonstrations. The regime accused me of illegal political activities, so in 19891 left Mandalay to join the northern ABSDF in the Kachin State, close to the Chinese “It was tough, most of us were city kids with no experience of living in the jungle. We built and lived in basic bamboo huts. The Kachin Independence Organization (KIO) supplied us with food, but it was difficult to survive, and many died. The Kachin didn’t completely trust us, as we were Burmans. They gave us a region to make money from jade mining and tax. It was 8,000 feet high, rocky, and difficult to grow rice or crops. We depended on supplies “In the rainy season the Burmese army attacked our positions, destroying our stores. We went without rice and salt for ten days. We became weak and those who got malaria died. I lost many friends, some only eighteen years old. Each of us got fifty kyat a month to live on. We existed by trapping and eating monkeys, rats, and porcupines . . . anything.

    “I was shocked to see people blown up and dead bodies. I had no battle experience, but I did fight. In 1990 we fought for forty days. I took command after our chief-of-staff was injured. We got weapons from the KIO and what we took from dead enemy soldiers.

    “At this time I was elected general secretary. I was in charge of our underground network. We used it to recruit students inside Burma. We began to notice we were able to go back and forth through enemy lines without problems, but we found we had recruited students who had family connections with Military Intelligence. Our numbers quickly grew to more than 800. We suspected our network had been infiltrated by MI. Reports from the front line indicated we were losing battles in suspicious circumstances. Our soldiers noticed knife marks had been cut in trees that could have led Burmese soldiers to our positions.

    “We started to watch some people. We arrested four or five and, after interrogation, we had a small list. The list included members of our central committee. We found out the National Intelligence Bureau had trained some of these as spies, and others were just used as informers. I think some were motivated by ultra-nationalistic visions of a Burman master race.

    “It was very difficult for us to know what to do. I panicked. We knew nothing about human rights, or, more to the point, we didn’t understand. We asked the KIO to help us to interrogate. By now we had a list of eighty spies. We made videotapes in case no one believed us. We chained the spies and locked them in the barracks.

    A Northern ABSDF central committee decided fifteen spies would be given the death penalty. We were at war, in armed struggle with the Burmese regime. Our constitution and law said we could give spies the death penalty. Many of our comrades had been killed because of these spies. Some members called for the death penalty for the entire eighty. We debated, argued, and finally agreed to fifteen. The sentences were determined by what the spies had done and how important they were to the [Burmese] military.”

    Aung Naing was distressed by his memories and having to replay the events leading up to the executions. I upset him further when I asked him how the death sentences were carried out.

    “Some of them were shot and some were beheaded. They were shot at close range by pistol by our officers. We thought the guns caused more suffering, so we thought if we switched to machetes it would be less. But they were not cleanly beheaded, even though the spinal cords were severed. I watched . . . it was done in front of all ABSDF soldiers.

    “We would have liked to free all of them—but if we had, it would have sent a message that we welcomed spies. It was a hard decision to make, and before we made it we approached, through the KIO, Amnesty International and the ICRC [International Committee of the Red Cross]. We needed help; we wanted to hand the prisoners

    over to them. They said they couldn’t do anything, as they could not reach us on the Burma-China border. “It was the hardest thing I’ve ever done. But we felt we had no choice. It was not uncommon for armed opposition groups in Burma to execute spies. The Burmese army just killed anyone they caught on the spot without a trial.”

    Aung Naing left the room to throw up. He came back and swallowed hard before he continued. “When life is peaceful, it’s easy to draw moral lines, but in war it’s different. In the jungle the only way to conduct politics is with armed struggle. It was said that the killings were politically motivated, but nobody gained any political advantage. We had no internal splits, none of us gained anything. Before the executions we ate fish paste, and after the executions we ate fish paste. It could have been eighty instead of fifteen. It is understandable the families are upset. We asked the parents to come and talk with us.

    The people who betrayed us were our friends. My friend, Htun Aung Kyaw [ABSDF chairman at the time], was executed. He was like my older brother. We were very close. He didn’t admit he was involved, but evidence showed that he was.

    “The fighting was hard. War is a different reality. We were isolated and had no connection with human rights groups. We had no opportunity to learn about democracy or human rights. If we had, it may have been different. I believed I needed to take responsibility and resolve the problem. There should be an investigation like South Africa’s Truth Commission. People need to know what really happened. The problem will be to get MI to hand over their files.

    We thought we were emulating our hero Aung San by going to the jungle to fight to free our country. We didn’t even know Burma was freed because of the Second World War.

    “I was 24. I thought I was old enough, but after this experience I knew I was too young to be a leader. I’m glad I’m out of politics.”

    During lunch with Aung Naing in Mae Hong Son a few days after the interview, I pointed my spoon at a pungent dish in a wok. Aung Naing laughed and said that it was monkey intestine.

    I hope some of you could remember the following true story occurred during 1990/1995 at the ABSDF, upper Burma student rebel camp, in the Burma’s Kachin State, near the China border. There were some 40 anti-government activists, unjustly tortured and sadly killed by fellow activists. I was one of them and this could be called as the memoirs of a student revolutionary.

    Please kindly read to taste some selected pages of my chronicle and if you wish to publish this teaser, please feel free to do so.

    I would like to discuss the future publisher who would be interested to publish the full book. I wrote it into a story form rather than as a plain diary to attract the reader’s attention and for easier and pleasurable reading.

    There is nobody in the left of us, from there; the whole camp can be seen. There is a cassette tape recorder recording from the very beginning.

    Aung Naing sits there first and starts the conversation with the reporter.

    First, Yin Dee takes some group photos of us. Then introduce one after another with Yin Dee.

    After that, her first question is “were you tortured during the interrogation?”

    I answered, “Now, we are in good shape.”

    “No, I just mean, were you tortured during the interrogation?”

    “Student army provides us proper medical attention.”

    “Were you tortured?” She raises her voice.

    “If injury is bad, they provide us intensive care.”

    She is staring at me and I wink to the cassette tape recorder and look her back with appeal.

    (Please don’t corner me, know by yourself)

    But, unexpectedly, Aung Naing saves the situation. “Yes, we beat them, whipped, kicked and everything. When it was needed, we apply electric shock and everything. They are very stubborn and cunning. If we did not do like that they would never speak.”

    Yin Dee seems to know the situation very well and her interest on the matter is running.

    Soon after that Than Zaw rings to Myo Win. Myo Win has to go to the telephone table and listen to it.

    What? Not disappeared, healed.

    Well, you have to perform alluding to the order whether it is disappeared or healed, get it good.

    We are puzzled with the words. But we slightly know that KIA informed student army to bring back Sow Win Than because he is cured, But Ta Yote Kyi, answerer of the KIA’s call, acknowledged heal as flee. So he informed it to Than Zaw. Than Zaw brought it to Myo Win.

    We are familiar with death for long times. In the beginning, all of us have been facing death as a closed neighbor and we have luckily escaped it.

    So, we are like undertakers, thinking of death as daily occupation. Undertaker thinks of the death as work and we think of the death of other as we survived. We take death from the other end. When you think of the survival at that time breeze, music, love, beauty and everything cannot come into your mind. Even kind, sympathy and considerate are the poisons for all of us. But, you have to note here is, there is different between survival and fighting back together.

    No reply from him.

    Ten minutes after, everybody in the house can hear the foot steps outside the house. Incident follows the sound two armed soldiers come into the house from the front door and at the same time. La Sai and Kyaw Htin Oo from the back door.

    La Sai and Kyaw Htin Oo approach Khin Mg Soe from the left and right at the presence of all of us. Kyaw Htin Oo push pointed Khin Mg Soe’s back of the head with recently hire gun. At the mean time, La Sai hand cuffs him in the back. It is as easy as a bird-catch to the personal staff officer of the chairman in the chairman’s house at the presence of chairman.

    Khin Mg Soe is beaten badly and driven out of the house.

    “Explain it to me”, I demand.

    Htun Aung Kyaw replies, “I green lighted it”.

    No, you are lying. You mean that you also green lighted them to swindle a hand-gun from a chairman.

    Cho Gyi butts in between us.

    Hey, chairman, this time, you are not insulted, but you are fucked.

    Now, now, I order all of you to have proper courtesy while you are speaking with chairman. Oh, I reach here today and I have to obey the order from my chairman friend. Well, I have a formal argument with you.

    Explain me about the situation that is no guard in your house. Next thing is more special. I want to bring back the case of Khin Mg Soe. No. No, please don’t tell me that you green lighted. You know nothing till it occurred. If you knew everything before hand, it was no need for them.

    After a moment, Nyi Nyi Kyaw askes Theik Htun Oo to arrange tea for all of us.

    As Theik Htun Oo leaves, Nyi Nyi Kyaw says, I have tried several times chairman about this detaining business but he reasoning has never paid proper attention. He even forced me not to continue at the last time.

    Now, it is up to you to reason your friend. I don’t want it to be overheard by others. That’s why I sent Theik Htun Oo out.

    At the mean time, we are informed that Khin Mg Soe had expired during the interrogation. It is told that Khin Mg Soe was very stubborn and chooses to die instead of confessing.

    We all agree on a thing that Khin Mg Soe was accused but not confessed yet. Therefore his body is still eligible to have a burial procedure according to ABSDF rules and regulations and Islamic rule.

    Htun Aung Kyaw replies that it is already finished.

    What? It would be putting in a pit and fill back the soil.

    Isn’t that enough?

    Good enough for dogs and cats.

    I go out of the house desperately.

    Am I wrong of coming here?

    Aung Min followed me and whispering me about the same old thing, “Nyi Nyi, do something in time, we cannot reason…”

    THE STORY

    Htun Aung Kyaw, Cho Gyi, Kyaw Wai and Zaw Htun are shivering in the drizzle and wind of February. In this region, temperature is below zero degrees centigrade at night. They four have no rain coat not heavy coat at all. Actually none of them is wearing decent clothing. None has even had the boots or shoes. They are just wearing worn out slippers.

    Than Chaung, Myo Win and gang have brought the every necessary things. They even have some extras. They have solid bamboo sticks, hand guns, autos, daggers and everything.

    “Hey, Than Chaung, Myo Win. You two will kill each other eventually. Wait the steps.

    As Cho Gyi stretches out his left hand, Myo Win chops the wrist with his sword.

    The hand drops down from the wrist and blood flowing out form both ends.

    Myo Win pokes the hand with the pointed tip of sword and lift it.
